I quit! But...

April 23rd, 2008 (04:45 pm)

My boss just finally gave me my paystubs today... I haven't gotten a paystub (until recently) since January.  Apparently, she was paying me a dollar less than I normally receive an hour.  I was suspicious of this, as I was working the same hours but was getting paid less.  I hoped I was wrong, and that she had just adjusted my claim from 1 to 0, so I was thinking that maybe I was just getting more taxes taken out of my checks, until today when I reviewed my paystubs.

I have a question: Is what my boss did legal?  I might mention that my two previous paychecks were at my normal rate, with paystubs to go with them.  I also have paystubs from before the 1st of the year proving my rate was one dollar an hour higher than what she had been paying me.

Do I have a leg to stand on here?  And can I take this information to anyone?

Any advice is highly appreciated.

Re: I know!

It looks like you might just have to speak with her, ask for the back pay if the amount is high enough, small claims court?

Another option especially with her changing your withholding without your permission is to report her to the IRS.

Re: I know!

Thank you honey! I have a friend who has a lawyer for a boyfriend... so she's gonna do some investigating. Sounds like what you, Jeff, and Jim have said is pretty much the answer so far.
